Commercial Chancery

Commercial
Our work covers a wide range of commercial disputes, from factually intricate contractual matters to complex cases of civil fraud and remedial trusts. Our barristers frequently appear in all divisions of the High Court handling commercial litigation, including the Commercial Court and the Technology and Construction Court. We have extensive experience of the weightiest commercial cases and the conflict of laws issues that they often involve. We are also adept at providing realistic and timely solutions to the legal problems encountered by smaller businesses, and we are well versed in the techniques required to obtain urgent relief when the preservation and recovery of assets are at stake.

Civil Fraud
Several members of Chambers have established reputations in the area of civil fraud and have pioneered the development of worldwide freezing (Mareva) and tracing orders. These cases typically involve allegations of deceit and breach of fiduciary duty, and claims against those who assist such breaches or receive their proceeds. Frequently issues of jurisdiction arise, particularly concerning the service of process abroad, the impact of the European Conventions and Regulations (in particular regulation 44/2001), and the recognition of judgments and orders made here and abroad.

Professional Negligence
Members practise in the field of professional negligence, both as a natural consequence of the work of Chambers as a whole and in its own right. Claims against solicitors and accountants are particular specialism's, and we also handle claims against surveyors, valuers, architects, engineers and financial advisers. Members act regularly for professional indemnity insurers and for lenders in property cases, where the developing jurisprudence of fiduciary duties and the restoration of funds held on trust are of particular importance.

Partnership
We provide all aspects of drafting, advisory, litigation and mediation services in respect of partnership issues and disputes, from the initial negotiation and drafting of partnership agreements through to partners' liabilities during the relationship, retirement and dissolution. Whether concerning large multi-national legal practices or smaller commercial enterprises, we appreciate the particular demands for speed, imagination, diplomacy and confidentiality which such cases often involve. Partnership disputes often involve a wide range of other legal issues. Whether these issues relate to property law, company law, insolvency, trusts or the administration of a dead partner’s estate, we have the experience to deal with them.

Intellectual Property
Some members of Chambers specialise in intellectual property law. They offer advisory, drafting and advocacy services in cases of trademark infringement, passing off, copyright and design right infringement, registered design infringement and breach of confidence. We are in the vanguard of the developing law of intellectual property rights on the internet and in e-commerce.

Telecommunications
We have substantial experience in this area, and have acted in cases concerning communications satellite usage contracts, referrals to ICSTIS and OFCOM, premium rate contracts, domain names, internet usage, website content, brand protection, terms and conditions of use of telecommunication services, and third party disclosure orders in relation to internet service providers.
