Comment:
Malcolm acted for the Defendant/Appellant in an appeal in relation to payments under an oral trade mark licence for the use of the well known trade mark SUPERDRY. The appeal was against an Order for summary judgment on the claim. The appeal was successful in relation to the main point, being the length of reasonable notice for termination of the relevant licence which thus allowed the continuation of a substantial Counterclaim by the Defendant for loss of profits arising from unlawful repudiation of the licence by the trade mark owner. The appeal was also successful in relation to another issue, being the ability of the repudiating party to recover monies which would have been due in respect of the period after the repudiation.
